My Employer Didn’t Pay Me What Can I Do UK – If you’re reading this, you’re probably in the unfortunate position where your employer owes you money as they have’nt paid you.
And it’s difficult to know where to go from there, right?
The good news is that there are legal avenues you can explore to ensure that you are paid by your employer – and the law is on your side here.
Your Employer Owes You Money – What Can You Do?
If you think your pay is incorrect or if you’ve not been paid at all, the first thing you should do is speak to your employer to find out if there’s been a mistake or if there’s a reason why.
If there’s a disagreement and your employer owes you money, you might need to take things further.
If you get to the end of the month and expect your pay to come as usual, but it doesn’t, it can cause you significant problems, ranging from being able to pay you’re rent or a mortgage, bills, plans and other financial commitments that you can’t avoid.
And even if your employer owing you money doesn’t cause immediate financial difficulties, you’re still out of pocket and have not been paid for the work you have undertaken.
It’s worth knowing that you can challenge your employer if there’s any disagreement over your pay.
You can start the process by speaking to a legal representative – whether that’s a solicitor, a trade union representative or the Citizen’s Advice Bureau.
Once you’ve done that, you can check whether there is a formal process for raising a grievance with your employer.
If there isn’t, you can still raise a grievance by writing a letter of complaint explaining why you think you haven’t been paid enough, what your pay should be and include any relevant evidence.
If the matter isn’t resolved after raising a grievance, you can take your employer to a tribunal.
To do so, you’ll need to inform ACAS (The Advisory, Conciliation and Arbitration Service) and they’ll contact your employer to see if they’re willing to agree to early conciliation. That is essentially a settlement without needing to go through the formal process of an employment tribunal.
However, if you can’t come to an agreement then you can still take your employer to a tribunal. This is usually seen as a last resort due to the time and stress involved in tribunal cases and the fact that it can be expensive.
The deadline for applying to the tribunal is 3 months (minus one day) from when you should have been paid. After this date, it’s incredibly difficult to obtain any missed payments from your employer.
