Why Do I Need A Solicitor For A Quick Divorce?

Even if you simply want a fast divorce, it is important to follow the correct process and also ensure that you do not have any ongoing liabilities. For example, if you do not sign a financial agreement, your former spouse could come back to you many years into the future and make a claim against you, as your obligations to each other do not end on divorce. They can only be ended with a separate order of the court, such as a clean break order or a financial consent order.

An experienced divorce solicitor will be able to ensure your interests are protected and that any financial agreement you enter into is right for your situation. They will also make sure that the correct process is followed, both in respect of your divorce application and any other orders that are needed.

Quickie Divorce FAQs

How long does a quickie divorce take?

If you ask one of our solicitors to represent you, they will go through the initial application to the court with you and file this as soon as possible. As from 6 April 2022, the Divorce, Dissolution and Separation Act 2020 applies to all divorces. This requires a period of reflection of twenty weeks between the application being made and the granting of a conditional order for divorce.

This period will give your solicitor the opportunity to deal with any other associated matters. Assuming your divorce goes through without delay, you should be able to obtain the final order within six months. There is no longer any scope to contest an application for divorce, meaning you cannot be trapped in a marriage that you wish to end.

What other issues must be dealt with on divorce?

If you have children, then you will need to agree on arrangements for their shared care with their other parent. Sometimes this can be done amicably, but if not, then you may need to go through a process of negotiation or mediation to settle on how their care will be dealt with.

An experienced divorce solicitor will be able to suggest how this can be managed and represent you in negotiations to ensure that the right solution is found for your children as well as for you.
Financial issues should also be settled on divorce. Again, this can be dealt with by negotiation, with your solicitor representing your interests and working to agree a settlement that can be approved by the court in a binding order.

If you have shared property, then this will also need to be included in the agreement. The court will want to be sure that these issues have been dealt with satisfactorily before granting orders for divorce.

How does the quickie divorce process work?

If you want a fast divorce, then your solicitor will start by making an application to the court for the initial order, a conditional order giving notice of the impending divorce. This will state that your relationship has irretrievably broken down. The application can be made jointly by both of you if you wish.

Where only one party makes the order, the court will, where possible, serve the order on the other party by email.

The conditional order will be issued no less than twenty weeks after the date of the application. Six weeks after the issuing of a conditional order, the court can issue a final order, meaning you will be divorced.

Because the court will want to be satisfied that finances and arrangements for children have been agreed upon, if you want a fast divorce, you will generally need to negotiate these, rather than ask the court to decide matters, which can be a lengthy process.
